On the topic of recommended ghusls (al-aghsal al-masnuna), please research what the commentators say are the most reliable positions. 

One could look at either of:

  • Bajuri on Fath al-Qarib
  • Khatib's al-Iqna (with al-Bujayrami's Hashiyah)
  • Kifayat al-Akhyar

To pick to of the Ashab al-Wujuh who have a student teacher relationship, which have not been already written on, and write biographies on them insha'Allah. Similar to last week.

Let's get started on here insha'Allah. The author, may Allah bless him and benefit us through him (ameen), lists the following occasions in which having a bath (ghusl) is recommended:

  • For Friday prayer
  • For he two eids
  • For the drought prayer
  • For the lunar eclipse prayer
  • For the solar eclipse prayer
  • After washing the dead
  • After becoming a Muslim
  • After regaining sanity
  • After regaining consciousness
  • For entering ihram
  • For entering Makka
  • For standing at 'Arafa
  • For spending the night at Muzdalifa
  • For throwing at the three pillars
  • For tawaf

The Friday Prayer
Some of the Ashab, as well as Imam Malik, held that ghusl for Friday prayer is actually wajib. They based this view on the hadith of Malik, al-Bukhari, Muslim, al-Nasa'i, and al-Tirmidhi that the Prophet, peace be upon him said: 'When any of you comes for Jumu'ah then perform Ghusl.' However, this is seen as a recommendation rather than a command by the majority of the scholars from the Salaf and Sahabah. The support for the view that it is sunnah and not wajib is the hadith in Abu Dawud, al-Tirmidhi, Ahmad, al-Nasa'i, and al-Bayhaqi that the Prophet, peace be upon him said: 'Whoever performs wudu on Friday, then that is well and good, but to do ghusl is better.' Al-Nawawi said that this hadith is sahih.

Shaykh Ismail in the nur al idah course asked us questions on the book, If you could ask us questions about the topics we covered that might be on the exam at the end 5 or 10 questions that we could use in the end as a study tool and summary of the book.

Here is my attempt. 

After Washing The Dead

There are two qauls regarding ghusl after washing the dead. According to Imam Syafi'i's qaul qadim, it is mandatory, since washing the dead is wajib. However the qaul jadid says that it is not wajib, but a sunnah. This is the preferred view.

The basis for this is the saying of the Prophet (sallallahu 'alayhi wasallam):
 



مَنْ غَسَّلَ مَيِّتًا فَلْيَغْتَسِلْ وَ مَنْ حَمَلَهُ فَلْيَتَوَضَّأْ






"Whoever has washed the dead, let him do ghusl, and whoever carries the dead, let him perform the wudhu'"












Imam Tirmidhi considered this hadith to be hasan. However Imam Ahmad says that this hadith is mawquf, stopping at the Companion Abu Hurairah (radhiyallahu 'anhu). Thus Imam Ahmad does not consider it (ghusl after washing the dead) to be wajib.












Imam Shafi'i said" If this hadith is Sahih, then I would have said it as being wajib.

Tirmidhi is noted to have related from Bukhari that Ahmad b. Hanbal and ‘Ali b. al-Madini stated that there is no sound reports under the discussion. And Bukhari’s teacher, Muhammad b. Yahya al-Dhuhli, stated that there is no established hadith under it.

I searched the issue of whether the the Ghusul is a sunna for Sa'ii and there is no explicit mention in the following books:

Al-Mu'tamad
Mughi-Muhtaj
Fiqh-Al-Manhaji
Hashiya Ibn Hajar Ala Sharh Al-Edah
Bushra Kareem
Umdat Al-Salik
Inayatul Talibeen Ala Fath Maeen

In the Shafi’ee fiqh, as mentioned by Qadhi Abi Shuj’aa in Matn Abi Shuj’aa, there are 17 different types of ghusl’s which are sunnah. One of them which he mentioned was the ghusl on the day of jum’a. However, there is a difference of opinion on this issue. Some scholars consider it waajib. Their daleel is an authentic hadith mentioned in the sahah sitta and in the musnad of imam ahmad that;


Abi Saeed Al Khudree (ra) said that Rasul Allah (saw) said: “The ghusl of the day of Jum’aa is waajib on every baaligh person.” (Narrated by Sahah Sitta and Ahmad. It is Sahih)


However, the position of the jamhoor is that it is masnoon (recommended sunnah). Their daleel is the following hadith;


Samura (ra) said: Rasul Allah (saw) said:”Whoever made wudu on the day of jum’a then he has done well; but whoever does ghusl then that is better.” (Narrated by Ahmad, An Nisaee, At Tirmidhi, Ibn Majah, Abu Dawud. At Tirmidhee says that it is Hasan)


The jamhoor say that if the ghusl on the day of jum’a was waajib, then the Prophet (saw) would not have used the word “Afdhal” for it in the 2nd hadith. Other than that, he said that wudu on this day was okay as well. If it was wrong, then the Prophet (saw) would have mentioned it clearly. Hence, the only way to reconcile between both these ahadith is that the word “waajib” used by the Prophet (saw) in the 1st hadith was just used as a sign of emphasis and not as a sign of obligation.


            However, the 1st hadith is stronger than the 2nd hadith in strength. Hence, in the end we can conclude that even though we can make wudu instead of ghusl on the day of jum’a; however, we must be extremely cautious towards fulfilling this sunnah; since the Prophet (saw) put great emphasis on this issue (as mentioned by Ibn Ul Qayyim (ra)).

It is mustahab on the days of Eid a-fitr and Eid al-adha as per saying of Ibn Abbas radiyAllahu anhu


كان رسول الله صلى الله عليه و سلم يغتسل يوم الفطر و يوم الأضحى


Narrated by Ibn Majah (Investigators say the hadith is weak, Al bazaar didn’t know any hadith related to ghusl on the days of eids that were saheeh)


Sayyidinaa Umar and Ali radiyAllahu anhumaa had also made ghusl on these days as It is a day where people gather (meet) just like Friday. It is permissible to perform the ghusl after Fajr without a difference of opinion. Some say it is permissible to make ghusl during the night (Allah knows best)
